Don Fountain and Jason Cornell recently settled a personal injury claim on behalf of a client who sustained permanent and catastrophic injuries due to the negligent construction of a fishing pier. The client and her friends were on a pier that extended over 100 feet out into a waterway. The “terminal” or end point of the pier lacked a railing, though permits and plans called for the installation of railing along all sides. During litigation, the insurer for the construction company that built the pier eventually tendered its policy limits. Through discovery, attorneys at Clark Fountain were able to show that the pier was not constructed according to permit or specifications.
